Ascender Consulting, LLC (“Ascender Consulting”, “AC”, “we”, “us” “our”, “Company”) owns and operates www.AscenderConsulting.com (“Website” or “Site”) and all affiliated social media platforms to include Instagram: Ascender.Consulting, Instagram: XMZ.Society and LinkedIn @JennAscender. The terms “user,” “you,” and “your” refer to site visitors, clients, and anyone who interacts with the Site or social media platforms of the Company.

The Company, Site and social media accounts adhere to the following Privacy Policy Agreement (“Privacy Policy”, “Policy”). We will not use or share your information with anyone or any agency except as detailed in this Privacy Policy.

By using the Site and engaging with AC on social media, you are herein consenting to the following data practices expressed in this Policy and the accompanying Terms of Use (“Terms and Conditions”).

Ascender Consulting believes in protecting the privacy of its visitors, clients, affiliates and partners. We respect your privacy and commit to protecting your privacy to the extent that we can reasonably do so. This Policy gives you the right to opt-out of specific data collection options such as unsubscribing to email notifications or newsletters and declining cookies.

This Privacy Policy Agreement applies to any information collected online or offline. This may include but is not limited to information collected via the Site, social media, phone, email, or by purchasing Services from the Company.

The purpose of this Policy to explain how your information is collected and may be used or disclosed by the Company.

The Company reserves the right to change and update this Policy at its discretion. When an update has occurred, the date will be notated at the top of this Policy in the “Last Updated” section. All updates to this Policy become effective upon publishing on the Site. You are responsible for keeping abreast of these changes as you continue to engage AC. You waive specific notice of any updates or changes to the Privacy Policy by continuing to use and access the Site, social media, Email and other broadcast or communication channels affiliated with Ascender Consulting. By continuing to use the aforementioned platforms, you agree to any changes or updates to the Policy.

To opt-out of Our Privacy Policy, you must not use the Site or engage with Ascender Consulting, LLC at any level.

This Policy only applies to AC and does not apply to third party partners such as Stripe, Google or AC’s affiliates. Please refer to third-party policies for clarification on their practices.

Children’s Online Privacy Protection Act (COPPA)

You must be 18 years old or older and be legally competent to utilize AC’s Site and Services. This website, in compliance with Children’s Online Privacy Protection Act (COPPA), is not intended for and should not be used by Children under the age of thirteen (13) years. Anyone under the age of 18 should receive parental consent prior to using the Website or engaging any content or information from Ascender Consulting through any platform or method. Anyone under the age of 18 should not submit personal information to Ascender Consulting through any form of communication. Ascender Consulting, LLC does not knowingly collect personal information from children under the age of 13 and we do not specifically market to anyone under the age of 18 years old.

If we learn that we have unknowingly collected data from children under the age of 18, it will be deleted immediately unless parental consent is received.

Why Do We Collect Data?

The information collected by AC is used to improve its Services, the Site, and other digital platforms. It’s also used to communicate with visitors, clients, affiliates, partners and anyone who visits the Site or AC social media platforms.

We use the information we collect to:

When Do We Collect Data?

The Company will learn information about you when you access the Website or other digital channels of AC. Some of this information is obtained automatically, and other information is given voluntarily by you during your visit or interaction with AC. Some information is collected by public accounts. Please refer to your Privacy setting on social media to prevent sharing of details you prefer to keep private.

Personal Information

Some of the information we collect may be personal information that can identify you and may include but is not limited to, first name, last name, email address, mailing address and phone number. Generally, this information is collected on a voluntary basis when you sign up for or purchase a Service. However, we may receive some of this information via a message on social media. For example, we may see your name, username, and location, on Instagram after you message us.

Volunteering your information is your decision made at your discretion. You are under no obligation to provide your information to the Company. However, refusal to submit some information may prevent you from receiving free resources or purchasing Services.

Log Data

Some information may be anonymous. This will be collected through derivative/log files on our Site or social media. The information that may be collected can include but is not limited to your Internet Protocol (IP) address, Internet Service Provider (ISP), browser type, your journey on the Site such as how long you stay on a page or which buttons you clicked, and how long you watched a video. This information does not personally identify you.

This also includes analytic data from third party sources like Google. Third-party services are not operated by the Company. Please refer to third party policies for more information on how your information is collected and used by them.

Cookies are used to collect data and stay on your system. We use cookies to improve our Site and Services. You can decline all cookies or some cookies via your browser. If you choose to decline all cookies, some of the features on our Site may not work appropriately. We encourage you to do what you’re most comfortable with.

The Company also reserves the right to use similar technology such as social media pixels to track how our Site and marketing is performing. AC will use these technologies in compliance with social media platforms such as but not limited to Meta and LinkedIn.

Some content or applications on the Site are serviced by third parties. These parties may use cookies. The cookies may collect personal or anonymous information about you, and your online activities. We do not control these third-party technologies. If you have questions about targeted content from one of these parties, contact the party directly.

Financial Information

The Company may receive financial data when you pay for a Service. Payment information is stored by the Company if submitted by check. However, if you submit payment through a third-party vendor such as Stripe or Venmo, your information may be stored by those third-party vendors. If you use a third-party processor to pay AC, please review the payment processor’s policies to learn more about how your financial data is collected and stored.

Our Site, emails and social media may contain links to third party websites, resources, social media accounts and content not controlled by the Company. The Company does not assume responsibility or liability for the security, privacy policy, practices, accuracy of content or resources of third-party websites or accounts. You acknowledge sole responsibility and assume all risk arising from your use of such websites, accounts and resources.

The Company uses reasonable care in including such external links; however, the Company does not regularly monitor the websites of third-party websites, accounts and resources. The Company is not bound by the Privacy Policies of any third-party website, account or resources, nor do those third parties abide by our Privacy Policy Agreement.

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

Third Parties We Share Your Data With

There are a few circumstances when your information may be shared with third parties.

How Long We Retain Your Data

We retain your data your Personal Data for various time frames. It depends on the purposes for which we use it. We may retain De-Identified Personal Data for as long as we deem appropriate.

Where your data is sent

Business Transfers

If the Company participate in a merger, bankruptcy, dissolution, reorganization, or similar proceeding, your information may be transferred as part of the proceeding. During such transitions, you acknowledge that your information can continue to be collected, stored and used according to this privacy policy.

International Data Transfer

By interacting with Ascender Consulting, LLS, you acknowledge that your information may be transferred outside of your state, region, country or other jurisdiction and thus may be transferred to a location where the data protection laws may differ from your location. The servers and operators of AC, the Site and other digital platforms are based within the United States. All information collected by AC is processed in the United States. This means if you are located outside of the United States, your information will be transferred and processed in the United States. You acknowledge and consent to our Privacy Policy Agreement including the transfer of your information to the United States.

Any concerns relating to the Site, social media, or Services of Ascender Consulting will be governed by the laws of the United States in the State of Florida, in Lake County in addition to the General Data Protection Regulation, as it applies to residents of the European Union, and the California Privacy Protection Act, as it applies to residents.
